You hit the nail on the head groink - trading is illegal. How can it not be? Ripping a DVD and posting it for people to download - of course it's illegal. Just because it happens to be a JDorama not LoTR or something makes no difference. TV broadcasts are the same, try ringing up Kiku and asking if it's OK to distrubute recordings of the programs they are paying to broadcast on the internet......

Modifying the tracker to store a 'token' as well as the IP of the downloader is not technically difficult and you could keep track of what is uploaded and downloaded - but given the above it does exactly what you said - defeats the purpose of an anonymous sharing protocol.

Addressing the KIKU-TV issue... It actually is legal (whew!!!!), according to the KIKU-TV's FAQ:

May I purchase copies of KIKU programs?
Due to copyright constraints, we are not allowed to make, rent, or sell copies of programs airing on KIKU. However, we do rebroadcast some shows, which allows viewers to watch episodes missed during the first run. We do make available our original programming (produced by JN Productions). If you have missed an episode, you can go to our Message Board to inquire if any other viewer has taped that episode and is willing to lend or trade you that copy.

Remember though... This is just KIKU-TV programming. It does not pertain to programming from other sources, so don't use the KIKU-TV info as a general guideline to legalize ALL Jdoramas. It would be best to obtain a written statement from these sources on exactly what's allows and what isn't.

Wow, that's pretty surprising that they would state that in writing... If the wrong person were to see this, KIKU could get in a world of trouble, wouldn't you think?

Nah, I think it's covered under fair use, as long as you don't show it to a large group of people. That's what I always thought, anyway...

True that. I think the disclaimers at the beginning of DVDs mentions public viewing and the like. But it does mention "illegal" duplication as well...

What you probably mean is would TBS have a problem with KIKU-TV allowing people to basically lend out or trade TBS property? They'd probably have a cow. But then again, maybe the agreement between KIKU-TV and TBS allows for that. Obviously, though, a lawyer didn't write the statement.

Due to copyright reasons (ie. it's illegal) we (KIKU) cannot make sell or copies, but you are free to do whatever you want as long as you don't get caught (sound of layer fainting in background), this message will self destruct in 10 seconds.

Because KIKU have only bought the right to broadcast the shows the copyright still remains with the original holder, I *guess* that the copyright restrictions must be in the contract you have with KIKU. Did you check the fineprint in the contract?

Ultimately it's not KIKU you have to worry about it's the copyright holder TBS, FujiTV, NHK or whatever - who probably have enough lawyer power to get over little hurdles like what KIKU are telling/told people.

If the JPN media authority makes their version of the RIAA, we'd have no more jdramas to watch anymore, or at least to DL.
